Hytale Magazine — Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Hytale Magazine website at hytalemagazine.com and the Hytale Magazine mobile application (together, the "Service"), operated by SIA "Synchron" ("we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 13 years old to create an account or use the Service.

If you live in the European Economic Area, the minimum age is the age of digital consent set by the country you live in under Article 8 of the GDPR. That is 16 unless your country has legislated a lower age, and it is never below 13. In other words, the minimum age is whichever is higher: 13, or your country's own threshold.

We set it this way so that everyone who holds an account is old enough to agree to these Terms and to the processing of their own data without a parent or guardian doing it for them.

If you are under the age of legal majority in your country but meet the minimum age requirement above, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Signup begins with a date-of-birth screen and does not continue if the date you give is below the minimum age that applies to you. We may ask you to verify your age at any time. If we learn that an account belongs to someone below the minimum age, we will close it and delete the associated data in accordance with our Data Deletion Policy.

2.1 Registration. To post content or use interactive features, you must create an account with a valid email address, a password, and a nickname. You may also upload an avatar image. You agree to provide accurate information during registration and to keep it up to date.

2.2 Security. You are responsible for keeping your password confidential and for all activity under your account. Notify us immediately at legal@hytalemagazine.com if you believe your account has been compromised.

2.3 One person, one account. Each person may maintain only one account. Creating additional accounts to evade enforcement actions or for any other purpose is prohibited.

2.4 No transfers. You may not sell, trade, give away, or otherwise transfer your account to anyone.

3.1 Ownership. You retain full ownership of the text, images, and other material you post through the Service ("User Content").

3.2 License to us. By posting User Content, you grant SIA "Synchron" a non-exclusive, royalty-free, worldwide license to display, reproduce, adapt (for formatting and layout purposes), and distribute your User Content:

(a) on the Service (website and mobile application);

(b) in editorial articles, features, and promotional materials published by Hytale Magazine.

3.3 Duration of the license. If you remove specific User Content, the license under Section 3.2 ends when the content is removed from the Service.

If you delete your account:

(a) Your user content is anonymized: your authorship is replaced by "Deleted User" and the link between the content and your account is irreversibly broken. The license under Section 3.2(a) ends at that point, because the anonymized content is no longer attributed to you. Note that the text or images within your posts may still contain information that identifies you regardless of authorship removal.

(b) You may request full removal of your content by contacting legal@hytalemagazine.com before or after initiating deletion. Once the content is removed, the license under Section 3.2(a) ends entirely for that content.

(c) The license under Section 3.2(b) survives only to the extent that the User Content has already been incorporated into a published editorial article or feature before the date of deletion. We are not required to remove or alter previously published editorial materials. Retention of such content is based on Article 17(3)(a) GDPR: the processing is necessary for exercising the right to freedom of expression and information.

3.4 What we may do with your content. For clarity, the license in Section 3.2 allows us to resize images, adjust formatting, excerpt text, and include User Content alongside editorial commentary. It does not allow us to claim authorship of your work.

By posting User Content, you represent and warrant that:

(a) you created the content yourself or hold all necessary rights to post it;

(b) the content does not infringe or violate any third party's intellectual property rights, privacy rights, or other legal rights;

(c) the content complies with these Terms and with our Community Guidelines and Content Policy.

If we receive a credible claim that your content infringes someone's rights, we will handle it in accordance with our Copyright Policy at hytalemagazine.com/legal/copyright.

Your use of the Service is subject to our Community Guidelines and Content Policy, which are incorporated into these Terms by reference. Please read them before posting.

6.1 Available measures. If you violate these Terms, the Community Guidelines, or the Content Policy, we may take one or more of the following actions:

Warning: a notice that you have violated the rules.

Mute: temporary restriction on posting or commenting.

Cooldown: a time-limited suspension of specific account features.

Suspension: temporary deactivation of your entire account.

Ban: permanent closure of your account.

6.2 Serious violations. In cases of severe or repeated violations, we reserve the right to apply any measure, including a ban, without prior warning.

6.3 Content removal. We may remove any User Content that violates these Terms, the Community Guidelines, or the Content Policy, or that we are required to remove by law.

6.4 Appeals. The process for appealing enforcement actions is described in our Community Guidelines.

You may delete your account at any time. The procedure and details about what happens to your data are described in our Data Deletion Policy. Deletion is subject to the surviving license described in Section 3.3.

All editorial articles, original artwork, site design, logos, and other materials created by or for Hytale Magazine (excluding User Content) are the property of SIA "Synchron" or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute our editorial content without prior written permission.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or secure, or that any content (including User Content) will be preserved. The Service is a free, community-driven project, and you use it at your own risk.

To the maximum extent permitted by applicable law in Latvia, SIA "Synchron" shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service.

Because the Service is provided free of charge, our total aggregate liability for any claim arising under these Terms shall not exceed €100 (one hundred euros).

Nothing in this section excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or willful misconduct.

Hytale Magazine is an independent fan project. It is not affiliated with, endorsed by, or officially connected to Hypixel Studios or any of its affiliates. "Hytale" and related names and marks are the property of their respective owners. For more details, see our Fan Disclaimer.

We may update these Terms from time to time. When we do:

we will post the revised version on the Service with a new "Last Updated" date;

for material changes, we will notify registered users by email or by a prominent notice on the Service at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of revised Terms constitutes acceptance. If you do not agree with the changes, you may delete your account as described in Section 7.

These Terms are governed by the laws of Latvia, without regard to its conflict-of-law principles.

Any dispute arising under these Terms shall be submitted to the competent courts of Latvia. If you are a consumer residing in the European Union, you retain the right to bring proceedings in the courts of your country of residence, and nothing in these Terms overrides mandatory consumer protections available to you under your local law.

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.

These Terms, together with the Community Guidelines, Content Policy, Copyright Policy, Privacy Policy, Data Deletion Policy, and Fan Disclaimer, constitute the entire agreement between you and SIA "Synchron" regarding your use of the Service.

In accordance with Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act), we designate the following single point of contact for communications from Member State authorities, the European Commission, the European Board for Digital Services, and recipients of the Service:

This contact point may be used to submit notices about illegal content under Article 16 DSA and for any other communications required under the DSA. For notices specifically about copyright infringement, use copyright@hytalemagazine.com (see our Copyright Policy at hytalemagazine.com/legal/copyright). For all other notices about illegal content, use this address.

Hytale Magazine is a volunteer-run fan project. We may discontinue the Service at any time. If we decide to shut down permanently:

(a) we will notify registered users by email at least 30 days before the shutdown date;

(b) during that notice period, you may export your data using the data export feature in your account settings;

(c) after the shutdown date, all accounts and personal data will be permanently deleted, except as required by law. The 14-day cancellation window described in our Data Deletion Policy does not apply when the Service is discontinued; deletion is carried out directly after the shutdown date.

The surviving license described in Section 3.3 remains in effect for content already incorporated into published editorial materials.
